Responsibility for Compliance: The traveller is responsible for adhering to passport, visa, customs, currency and health regulations. Swiss Dream Escapes cannot be held liable for any refusal of entry due to delayed, missing or incorrect documentation.

Travel Insurance: Travel insurance is not included in the travel arrangements. We strongly recommend to take out comprehensive travel insurance covering personal belongings, accidents, medical emergencies, evacuation, cancellation and trip curtailment.

Ensuring these precautions will help make the journey with Swiss Dream Escapes as seamless and enjoyable as possible.

GENERAL TERMS and CONDITIONS

1. SCOPE

We are pleased to be able to take care of your travel wishes. We arrange individual tourist services or travel packages for you and your customers.
These General Terms and Conditions shall govern the relationship with Swiss Dream Escapes by Clara Dürrwang (hereinafter “Swiss Dream Escapes” or “we”) and you as our client (hereinafter “client” or “you”).

2. CONCLUSION OF CONTRACT

Your bookings shall be accepted as long as the requested services are available and only upon our written confirmation. If a booking request for services is placed electronically (e.g. e-mail, via website, SMS), we will confirm the receipt of the booking request by electronic means. However, this confirmation of receipt of the request does not yet constitute a confirmation of the booking. The bookings will only be confirmed once the booking has been re-confirmed with the provider of the individual travel service(s) or travel package. Further, bookings shall only be deemed to have been confirmed, once we have received the applicable deposit payment (see section 5 below).

3. PRICING

Swiss Dream Escapes pricing includes customised program design, booking services, reconfirmation of all agreed services prior to the start of your arrangement and the delivery of travel documents within Switzerland. All rates listed in our offers are in Swiss Francs (CHF) and include VAT. Swiss Dream Escapes reserves the right to increase the price under certain circumstances (see section 10). A non-refundable last-minute booking fee of CHF 300.00 shall apply for requests made or confirmed within 72 hours prior to the start of the arrangement.

Please note that changes to bookings made close to the travel date may incur significantly higher fees. The exact amount and any additional costs, will be communicated at the time of the request for the change.

4. GENERAL CONTRACTUAL OBLIGATIONS OF SWISS DREAM ESCAPES

Under these Terms and Conditions, you will receive travel advice to the best possible extent. Upon request, we will submit the booking request to the provider(s) and arrange your individual travel service(s) or travel package. Once the provider confirms the booking, we will provide you with your travel documents related to the booked travel service(s) or travel package, unless it has been agreed that the documents will be sent directly to you by the service provider.

Swiss Dream Escapes shall only be liable within the limits of applicable law and contractual agreements for the accurate selection of information sources and its correct communication to the you as well as for the careful selection of the service provider(s). However, we are not liable for the accuracy and completeness of the information provided by third parties as such it may change at any time.

Swiss Dream Escapes shall only be liable for carefully processing your booking(s) but never for the performance of the travel service(s) itself.

In case of special requests, Swiss Escape Dreams will forward them to the service provider. Unless explicitly agreed otherwise, we are not responsible for fulfilling such special requests. Special requests are only binding if explicitly confirmed by the provider.

5. DEPOSITS and PAYMENTS POLICY

The booking of travel service(s) or travel package is subject to the following deposit payment: 

• To confirm a booking of travel service(s) or travel package, Swiss Dream Escapes requires 25% deposit payment of the final price for the travel service(s) or travel package offered. The deposit payment is non-refundable under any circumstances. The remaining 75% balance of the final price is due 60 days prior to the start of the arrangement.

• To confirm a booking of travel service(s) or travel package within 60 days to 15 days prior to the start of the arrangement, Swiss Dream Escapes requires full payment of the final price for the travel service(s) or travel package within 48 hours from the booking.

• To confirm a booking of travel service(s) or travel package within 14 days prior to the start of the arrangement, Swiss Dream Escapes requires full payment of the final price for the travel service(s) or travel package within 24 hours from booking.

Swiss Dream Escapes reserves the right to cancel the booking and to retain 25% deposit payment of the final price of the travel service(s) or travel package in the event that the payments have not been received within the agreed terms for payments as set out above.

Swiss Dream Escapes reserves the right to change and notify the above payment policy according to the type of requested travel service(s) or travel package offered (e.g. train ticket, chalet rental, car rental, etc.), Swiss Dream Escapes will inform you in case of such changes.

Additional services or products booked though us during the arrangement must be paid immediately by credit card. We will send you a respective link for the secured payment. The booking of such additional services or products is only confirmed once we have received the payment.

The travel documents and final travel itinerary will be delivered 7 days prior to the start of the arrangement and only after receipt of the full invoice amount, unless otherwise agreed between the parties.

5.1 Bank Transfers

Bank transfers shall be made in Swiss Francs (CHF) to the bank account as set out below and must be made with “no charges for the beneficiary”.

5.2 Credit Card Payment

All payments by credit card will be subject to a non-refundable and non-commissionable 3% fee which will be added to the final invoice. All payments will be charged in local currency Swiss Francs (CHF) at the purchase rate valid on the day the bank charges the fee. For this reason, there are possible deviations with respect to the offered price and the actual amount charged on the credit card. Payments will be processed via an electronic secure payment link in Swiss Francs (CHF).

6. CANCELLATION POLICY

Notice of cancellation must be given to Swiss Dream Escapes in written form via email to info@swissdreamescapes.com and shall only be deemed to have been validly received upon confirmation by Swiss Dream Escapes.

If you or your customer cancels the travel service(s) or travel package, the following cancellation fees will apply:

• More than 45 days prior to the start of the arrangement: 25% of the final price (non-refundable deposit).

• 45 – 22 days prior to the start of the arrangement: 50% of the final price.

• 21 – 10 days priort to the start of the arrangement: 75% of the final price.

• 9 days or less prior to the start of the arrangement: 100% of the final price (no refund).

For some services or products there might be different cancellation policies especially during high-season (e.g. Christmas Season, New Year’s Eve, etc.). They will be brought to your attention before booking and Swiss Dream Escapes will confirm these at the time of the booking confirmation.

Name and/or date changes are not always permitted and might be treated as a cancellation. All cost related to such change requests will be charged to the client.
No refund will be granted on non-refundable services or products.

7. PREMATURE TERMINATION OF THE ARRANGEMENT

If you or your customer wish to end the arrangement prematurely, no refund will be provided for the remaining services or days of the arrangement. If you or your customer choose to end the arrangement early, we will assist you to the extent possible in organising the return journey. Any costs, e.g. for transportation, etc., will be borne by you.

8. SPECIAL CONDITIONS FOR CAR SERVICES ONLY BOOKINGS

a) Confirmation Policy
• Full payment of the final price is required upon confirmation.

b) Cancellation Policy
• More than 7 days before the pickup time: 25% cancellation fee of the final price.
• Less than 7 days before the pickup time: 100% cancellation fee of the final price.

c) Waiting Time and Extra Hours

• Airport Locations (Commercial Flights): 45-minute waiting time included. After that, hourly charges apply based on the vehicle type.
• Non-Airport Locations: 15-minute waiting time included. After that, hourly charges apply based on the vehicle type.
• No-Show Policy: No-shows at the pickup point are non-refundable. If the drive cannot be found and we are not contacted immediately to solve the issue, the payment remains non-refundable.

9. COMPLAINTS

If the trip does not comply with the arrangement as agreed, if you or your customer have any complaints or if you or your customer suffered any damage, you or your customer have to inform the local representative or the relevant service provider (e.g., hotel, transfer company) immediately. This usually allows for the issue to be resolved on-site.

If the issue cannot be resolved on-site, you or your customer must request written confirmation of the complaint and its details. You must submit such complaint (including the confirmation from the service provider) to us in writing via email to info@swissdreamescapes.com within 10 days of the end of the arrangement. Failure to meet these requirements will result in the forfeiture of any claims.

10. PRICE INCREASES AND CHANGES TO THE ITINERARY

Swiss Dream Escapes reserves the right to adjust the contractual price due to increases by third-party service providers (e.g., transportation companies), newly introduced or increased taxes, fees, or other charges and exchange rate fluctuation.
Swiss Dream Escapes reserves the right to make changes to travel arrangements. These changes shall be fully documented and communicated as early as possible. Some changes may require the provision of an alternative service, which shall be of at least equivalent quality and value.

11. CHANGES TO THE ITINERARY

In the unlikely event of any unforeseen itinerary changes due to flight delays or cancellations, adverse weather, strikes, pandemics/epidemics or any other circumstances (non-exhaustive list) beyond the control of Swiss Dream Escapes, all related expenses (e.g., accommodation, transfers) shall be fully borne by you. Swiss Dream Escapes accepts no liability for any changes, omissions, strikes or communication disruptions. No entitlement shall arise to claim damages against Swiss Dream Escapes.

12. CHANGE REQUEST

If you request to change or re-schedule a program after confirmation, Swiss Dream Escapes will make every effort to accommodate your request. A flat fee of CHF 250.00 will be charged for each service modification. If Swiss Dream Escapes is able to accommodate your request for change or re-scheduling, any additional costs necessarily incurred will be charged to you and communicated in an updated payment and deposit schedule. The revised payment and deposit schedule must be accepted by you within 5 (five) days upon receipt.

13. RENOVATIONS / CONSTRUCTION

Please note that hotels and venues may undergo renovations from time to time and they will make every effort to minimise any disruption to guests. If Swiss Dream Escapes is informed of any renovation work, you will be notified accordingly. However, the timing and scope of renovations are subject to change. Swiss Dream Escapes does not accept complaints or refund requests due to renovation work taking place during the traveller’s stay.

14. LIABILITY

Swiss Dream Escapes is not liable for any deficiencies and damages incurred by you or your customer in connection with the individual travel service(s) or package.

Our liability due to the breach of our duties to book and arrange travel services remain unaffected by the above provision and is limited to the extent permitted by law. In any case, we are only liable for damages caused by intentional or gross-negligent acts or omissions in connection with our booking of the services and activities. Liability is expressly excluded for slight negligence as well as for indirect or consequential damages (including but not limited to loss of profits or revenues, loss of goodwill or reputation, etc.).

The liability for sub-contractors is waived and Swiss Dream Escapes cannot be held liable for any damage caused by third parties.

Even though we arrange all services carefully, Swiss Dream Escapes cannot guarantee that schedules will be adhered to. Delays may occur due to heavy traffic, traffic jams, accidents, airport congestion, diversions, delayed border clearances, etc. In all these cases Swiss Dream Escapes cannot be held liable. Swiss Dream Escapes strongly advises you to take possible delays into account when planning the trip.

15. WAIVER OF LIABILITY IN CONNECTION WITH HIGH-RISK AND SPORTING ACTIVITIES AND BOOKING OF LOCAL EVENTS

Certain high-risk and sporting activities may require a waiver of liability to be signed by you or your customer at any time prior to the start of the activity. You and/or your customer herewith understand and agree that Swiss Dream Escapes and/or certain third-party suppliers may require participants in a planned activity to sign a waiver of liability. If a participant refuses to sign such a waiver, they may not be permitted to participate in the activity, respectively the activity cannot take place until such a waiver has been signed and provided to Swiss Dream Escapes or the third-party provider. Swiss Dream Escapes accepts no liability for any high-risk and sporting activities, which are undertaken entirely at the participant’s own risk.

Outside the agreed travel arrangement, it may be possible to book local events or excursions during the trip. However, these activities may carry certain risks. It is your, respectively the customer’s, responsibility to decide whether to participate in such events and excursions or not. These events and excursions are organised by third parties, Swiss Dream Escapes is not the contracting party and is not liable in any way.

16. FORCE MAJEURE

No party shall be liable to the other party, except for any obligations to make payments to the other party as set out in this section 15, or be deemed to have defaulted under or breached this agreement, for any failure resulting in the inability to conduct the offered service(s) or package when and to the extent such failure is caused by or results from the following force majeure events, such as:

(a) natural disasters such as floods, fires, or earthquakes;
(b) declared war, terrorism in the host city of the arrangement, or riots within a five-mile radius of the program location;
(c) epidemics or pandemics (excluding COVID-19);
(d) government orders or laws (excluding mandates requiring guests to be vaccinated against COVID-19);
(e) embargoes or blockades;
(f) strikes or labour stoppages; and
(g) shortages of adequate power or infrastructure.

If an arrangement is terminated due to force majeure, Swiss Dream Escapes shall return to you all amounts paid to Swiss Dream Escapes less the following (which Swiss Dream Escapes shall be entitled to retain or collect):

(a) the 25% deposit payment of the final price for the travel service(s) or travel package offered; and
(b) any out-of-pocket costs Swiss Dream Escapes is obligated to pay.

17. DATA PROTECTION POLICY

To process bookings and ensure that arrangements meet your requirements, Swiss Dream Escapes will receive personal data from you or third parties, such as other travellers included in the same booking. You and any third parties providing such data represent and warrant to Swiss Dream Escapes that you are authorised to collect and disclose this information.

Swiss Dream Escapes complies with Swiss data protection laws and regulations and has implemented appropriate security measures to safeguard personal data. Personal data will only be shared with third parties where necessary for fulfilling the booked arrangement. Further information on data protection can be found via the following link Privacy Policy.

18. APPLICABLE LAW AND PLACE OF JURISDICTION

Swiss law (excluding the provisions on the conflict of laws) shall be applicable. The place of jurisdiction is Uster, Switzerland.
